Terms of use

Last updated:

These terms are the agreement between you and Grudgeon (“we”) for using Grudgeon in a browser, in the iPhone and Android apps and on this website. By playing, you accept them. If you don’t, please don’t play. How we handle your data is in the privacy policy.

The short version

  • Grudgeon is free to play. Be decent: no offensive names, no cheating.
  • Gold, gear and everything else in the game has no money value and stays in the game.
  • Your fighter is public: other players fight it, and anyone with its link can see it.
  • We may change or close the game, and suspend players who break these terms.
  • If you are a consumer, the mandatory protections of the law where you live still apply.

Who we are

Grudgeon. Write to support@grudgeon.com.

Who can play

You must be at least 13 years old. If you are under 18, or under the age of majority where you live, you need a parent or guardian’s permission, and they accept these terms on your behalf.

Your fighter and your device

You don’t need an account or a password. Your fighter is tied to a key stored on the device where you created it, so anyone who can use that browser or phone can play as you. Look after it.

If you like, save your fighter with Sign in with Apple or Google, from Settings. Signing in with that account on any device then brings the fighter back, and whoever controls that Apple or Google account controls the fighter.

To move a fighter that is not saved, use a claim code from Settings. If you clear your browser’s data or uninstall the app before saving or moving it, the fighter is lost and we cannot get it back, because we have no way to know it was yours.

Fighters are personal. Don’t sell, buy or trade them, or the items on them, for money or anything outside the game.

Fair play

When you play, don’t:

  • pick a name that is offensive, hateful or sexual, pretends to be someone else (us included), or contains anyone’s personal details. We may rename it;
  • cheat: use bots, scripts, modified clients, exploits or automated requests to play, or to get gold, items or wins;
  • attack or overload the service, try to reach the server in ways the game doesn’t offer, or get around rate limits or other protections;
  • harass other players, including with challenge links;
  • use Grudgeon for anything illegal.

If you find a bug that gives an unfair advantage, tell us at support@grudgeon.com instead of using it.

Your fighter in public

You keep whatever rights you have in your fighter’s name. You give us a free, worldwide licence to store, show and share your fighter’s name, look, build and fight results, inside and outside the game (in the arena, on challenge links, in replays, share cards and link previews), for as long as the game runs. Deleting your account ends this licence for the future; replays that already exist stay, as the privacy policy explains.

Gold, items and other virtual things

Gold, gear, materials, boons and everything else you earn or receive in Grudgeon are a limited licence to use them in the game. They are not your property, have no value in money, cannot be exchanged for money or real goods, and cannot be sold or transferred outside the game. We can change how they work, for example to balance the game, and they end when your account is deleted or the game closes.

In the arena, other players can win some of your unbanked gold, and you can win theirs. That is part of the game. Fights from challenge links never cost gold.

Purchases

The browser game has nothing to buy. In the iPhone and Android apps you can buy optional items, such as cosmetics and a season pass. Nothing you can buy improves your fighter’s stats or fight results.

Apple or Google takes the payment under its own terms, and shows the price before you buy. Refunds are requested from them: Apple at reportaproblem.apple.com, Google through the Google Play order history.

The season pass also comes as a monthly or yearly subscription. It renews automatically at the price shown until you cancel it in your App Store or Google Play subscription settings. Cancelling stops the next renewal; the pass lasts until the end of the period you paid for. An introductory price, when offered, applies once, then the regular price follows. If a renewal payment fails, the store may retry it for a few days, and the pass stays on meanwhile.

Items are delivered straight away. By buying, you ask us to deliver the digital content immediately and accept that, as a consumer in the EU or the UK, you then lose your 14-day right of withdrawal. That does not affect your rights if an item is faulty or never arrives: write to support@grudgeon.com.

Ads

In the apps, some rewards can be earned by watching an ad, only when you choose to. Without the season pass, a short ad also plays every 7 fights. The ads are served by Google AdMob. Rewards are limited per day, and we may change them.

Our game

Grudgeon, its art, writing, code and the commentator’s opinions belong to Grudgeon or its licensors. We give you a personal, non-exclusive, non-transferable and revocable licence to play it for your own non-commercial use, under these terms.

Share screenshots, recap lines, replays and videos of your fights as much as you like, including on streams and monetised videos. Otherwise, don’t copy, sell or reuse the game or its content.

Changes, outages and closing

We keep working on Grudgeon, so features, balance and content change. The game will sometimes be unavailable, and one day we may close it. If we do, we will announce it in the game at least 30 days before.

Suspension

We may rename a fighter, take it out of the arena, or suspend or delete an account that breaks these terms or puts other players or the service at risk. Where we can, we will tell you why. You can stop playing and delete your account at any time.

No guarantees

Grudgeon is provided as it is. As far as the law allows, we do not promise that it will always be available or free of bugs, or that progress will never be lost.

Liability

As far as the law allows, we are not liable for indirect or unforeseeable losses, or for events outside our reasonable control, and our total liability to you is limited to what you paid us in the 12 months before the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or intentional misconduct, or for anything else the law does not allow us to limit.

Applicable law and disputes

If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can bring a claim in its courts. Please write to us first: most things can be sorted out by email.

If you got Grudgeon from the App Store

  • These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
  • Your licence to use the app is limited to Apple-branded devices that you own or control, as the Usage Rules in the App Store Terms of Service allow, except that other accounts in your Family Sharing group may also use it.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet a warranty that applies to it, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
  • If someone claims that the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
  • You must follow any third-party terms that apply when you use the app, such as your mobile carrier’s.
  • Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple may enforce them against you.

If you got Grudgeon from Google Play

The Google Play Terms of Service also apply to your download and to any purchase. Google is not a party to these terms and is not responsible for the app.

Changes to these terms

We may update these terms, for example when we add a feature. We will change the date at the top and tell you in the game before an important change takes effect. If you keep playing after that, the new terms apply. If you don’t agree, stop playing and delete your account.
